Terms of Service
Effective October 4, 2026
These terms govern your use of TrusteeSaleData at www.trusteesaledata.com (“the service”, “we”, “us”). By using the site or creating an account, you agree to them. If you do not agree, do not use the service. How we handle personal information is covered separately in our Privacy Policy.
What the service is
TrusteeSaleData collects notices of trustee’s sale that were published as public legal notices, extracts structured fields from them (such as the property address, sale date, trustee and unpaid balance), and makes them searchable. The methodology describes how that is done and what it misses.
We are not a government agency, a county recorder, a trustee, a lender, a real-estate brokerage, or a law firm, and we are not affiliated with any trustee, lender or servicer named in a notice.
The data has limits
Each record reflects a notice as it was published. After publication, a sale is often postponed, rescheduled, reinstated or canceled, and we may not learn of it. Extraction from notice text can also be wrong or incomplete. So:
- the service is for research and lead generation, and it is not an authoritative record of any sale, debt or title;
- always confirm the status, date, time, place and terms of a sale with the trustee named in the notice before you act on it;
- nothing on the site is legal, financial, tax or investment advice.
If a record disagrees with its source notice, tell us at support@trusteesaledata.com and we will check it.
Accounts
- You can sign in with Google or with a one-time link sent to your email address. You must give an email address you control.
- You must be at least 18 and able to form a binding contract to create an account.
- An account is for one person. Do not share your sign-in or let others use your account.
- You are responsible for activity on your account. Tell us promptly at support@trusteesaledata.com if you think someone else has used it.
Paid plans
The full record, the original notice text, saved searches, alerts and export come with a paid plan: Starter ($29 a month), Pro ($49) or Business ($99), as described on the pricing page. Without a plan, you can see how many sales each page and each search covers, and the soonest five sales on each page’s list with their full address and sale date. Every other sale, and the full record on every sale (such as the unpaid balance and the borrower), open with a plan. What you can see without a plan is described on the pricing page and may change. Starter opens full records and alerts in one state you choose, which can be changed once every 30 days; Pro and Business cover every state.
- Who you pay: payments are processed by Creem, which acts as merchant of record and is the seller of the subscription for payment, tax and invoicing purposes. Any sales tax or VAT due is added at checkout. Creem’s own terms apply to the payment.
- Free trial: every plan starts with a 7-day free trial. A card is taken at checkout and nothing is charged during the trial. Everything in the plan is open during the trial except CSV export, which opens with the first payment. Unless you cancel before it ends, the first monthly payment is taken when it ends. One trial per account; an account that has subscribed before starts paying straight away.
- Renewal: plans are billed monthly and renew automatically until you cancel. Cancel any time from your account page (Manage billing). Canceling stops the next payment, and your plan stays open until the end of the period you have paid for.
- Changing plans: moving to a higher plan takes effect at once and the difference for the rest of the period is charged then; moving to a lower plan refunds the unused part. During a trial a change costs nothing until the trial ends.
- Failed payments: if a payment fails, the card is retried. Records stay readable meanwhile, but alerts and export pause until the payment goes through, and the plan ends if it never does.
- Refunds: if the service does not work for you, email support@trusteesaledata.com within 7 days of a payment and we will refund that payment; the plan ends when it is refunded. Otherwise, payments for a period that has started are not refundable, except where the law requires it.
- Changes to prices: we will email you at least 30 days before a price change applies to your plan, and never change the price of a period you have already paid for.
Acceptable use
You may use the service and the data you get from it for your own business. You agree not to:
- resell, sublicense, republish or redistribute the data in bulk, or use it to build a competing database or service;
- scrape, crawl or download the site by automated means beyond what our robots.txt allows, or get around plan limits, rate limits or access controls;
- use the data to decide anyone’s eligibility for credit, insurance, employment or housing. TrusteeSaleData is not a consumer reporting agency, and the data is not a consumer report under the Fair Credit Reporting Act;
- use the data to harass, threaten, stalk or defraud anyone, including borrowers named in a notice, or to run foreclosure-rescue or equity-stripping schemes;
- contact people in violation of telemarketing, anti-spam or do-not-call laws;
- interfere with the service, probe it for vulnerabilities without our permission, or break any law in using it.
Ownership
The underlying notices are public records. The site itself — its software, design, and the way we compile, structure and verify the data — belongs to TrusteeSaleData. These terms give you a limited, non-exclusive, non-transferable right to use the service as they describe. Anything you save, such as searches and alerts, stays yours.
Emails
By creating an account you agree to receive the service emails needed to run it, such as sign-in links. Alert emails are sent only for alerts you turn on, and each one has an unsubscribe link.
Suspension and closing an account
You can close your account at any time by emailing support@trusteesaledata.com. We may suspend or close an account that breaks these terms, and we will tell you why unless the law or a safety concern prevents it. If we close an account without cause, we will refund the unused part of any period you have paid for.
Disclaimers
The service and all data are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. We do not promise the service will be uninterrupted, error-free, or complete for any county or state.
Limitation of liability
To the fullest extent the law allows, TrusteeSaleData will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost opportunities or losses from a purchase, bid or decision made in reliance on the data. Our total liability for any claim about the service is limited to the greater of the fees you paid us in the three months before the claim, or US$50. Some jurisdictions do not allow these limits, so they may not fully apply to you.
Indemnity
If your breach of these terms, or your misuse of the data, leads to a claim against us, you agree to cover our reasonable costs and losses from that claim.
Changes to these terms
We may update these terms. The effective date above will change when we do, and if a change materially affects account holders we will email you before it takes effect. Continuing to use the service after that means you accept the new terms.
General
If any part of these terms cannot be enforced, the rest still applies. Not enforcing a term is not a waiver of it. These terms, together with the Privacy Policy, are the whole agreement between you and us about the service.
