Colorado foreclosure laws

Colorado runs its trustee's sales through each county's public trustee: the sale is set 110 to 125 days after the notice of election and demand is recorded, and the combined notice runs in the paper once a week for five weeks.

What Colorado law requires

Notice before the sale

Combined notice mailed 45 to 60 days before the first scheduled sale

C.R.S. § 38-38-103(1)(b)
The statute’s own words
“No more than sixty calendar days nor less than forty-five calendar days prior to the first scheduled date of sale, the public trustee shall mail a combined notice”C.R.S. § 38-38-103(1)(b)
Newspaper publication

Once a week for 5 consecutive weeks

C.R.S. § 38-38-103
The statute’s own words
“for four weeks, which means publication once each week for five consecutive weeks”C.R.S. § 38-38-103
When and how the sale is held

110 to 125 days after the notice of election and demand is recorded (non-agricultural property)

C.R.S. § 38-38-108(1)(a)
The statute’s own words
“no less than one hundred ten calendar days nor more than one hundred twenty-five calendar days after the date of recording of the notice of election and demand”C.R.S. § 38-38-108(1)(a)
Right to cure or reinstate

Notice of intent to cure due 15 days before the sale

C.R.S. § 38-38-104(1)
The statute’s own words
“no later than fifteen calendar days prior to the date of sale, a written notice of intent to cure”C.R.S. § 38-38-104(1)
Postponement

Continued week to week, never past 12 months from the original date

C.R.S. § 38-38-109(1)(a)
The statute’s own words
“No sale shall be continued to a date later than twelve months from the originally designated date in the combined notice”C.R.S. § 38-38-109(1)(a)
Redemption after the sale

Junior lienors may redeem after the sale, on the statute's conditions

C.R.S. § 38-38-302(1)
The statute’s own words
“A lienor or assignee of a lien is entitled to redeem if the following requirements are met to the satisfaction of the officer”C.R.S. § 38-38-302(1)

Data as of Oct 5, 2026 · sale counts recomputed nightly

Colorado law requires 110 days, and the notices we hold run a median of 54 days from first publication to the sale. That is shorter than the statutory minimum because the minimum runs from an earlier step — the recorded notice or the mailing to the borrower — while this counts from the day the notice first appeared in a newspaper.

Colorado questions

How much notice is required before a trustee sale in Colorado?↗

Combined notice mailed 45 to 60 days before the first scheduled sale, under C.R.S. § 38-38-103(1)(b). In practice, a notice we hold in Colorado first appears in a newspaper a median of 54 days before the sale it announces, across 650 sales.

Can a Colorado trustee sale be stopped by paying what is owed?↗

Colorado allows reinstatement: notice of intent to cure due 15 days before the sale, under C.R.S. § 38-38-104(1). The amount due is the arrears and the costs allowed, not the entire loan.
