Montana foreclosure laws

Montana mails notice 120 days before the sale, publishes for three weeks, lets a borrower pay up to the moment of the auction — and allows no deficiency judgment at all.

That is shorter than the statutory minimum because the minimum runs from an earlier step — the recorded notice or the mailing to the borrower — while this counts from the day the notice first appeared in a newspaper.

Can a Montana trustee sale be stopped by paying what is owed?↗

Montana allows reinstatement: any time before the hour fixed for the sale, under MCA § 71-1-312(1). The amount due is the arrears and the costs allowed, not the entire loan.
