North Carolina foreclosure laws

North Carolina is the outlier: the sale runs through the clerk of court, the bidding stays open for 10 more days after the hammer falls, and each upset bid restarts the clock.

What North Carolina law requires

Newspaper publication

Once a week for at least 2 successive weeks; posted 20 days before

N.C.G.S. § 45-21.17(1)bN.C.G.S. § 45-21.17(1)a
The statute’s own words
“The notice shall be published once a week for at least two successive weeks”N.C.G.S. § 45-21.17(1)b
“at least 20 days immediately preceding the sale”N.C.G.S. § 45-21.17(1)a
When and how the sale is held

Between 10:00 A.M. and 4:00 P.M. on a day the clerk’s office is open

N.C.G.S. § 45-21.23
The statute’s own words
“The sale shall be held between the hours of 10:00 A.M. and 4:00 P.M. on any day when the clerk’s office is normally open for transactions”N.C.G.S. § 45-21.23
Bidding and payment

Bidding stays open: an upset bid of 5% or more restarts a 10-day period

N.C. Gen. Stat. § 45-21.27(a)N.C. Gen. Stat. § 45-21.27(a)N.C. Gen. Stat. § 45-21.27(a)
The statute’s own words
“for an amount exceeding the reported sale price or last upset bid by a minimum of five percent (5%) thereof, but in any event with a minimum increase of seven hundred fifty dollars ($750.00)”N.C. Gen. Stat. § 45-21.27(a)
“there may be successive upset bids each of which shall be followed by a period of 10 days for a further upset bid”N.C. Gen. Stat. § 45-21.27(a)
“When an upset bid is not filed following a sale, resale, or prior upset bid within the time specified, the rights of the parties to the sale or resale become fixed.”N.C. Gen. Stat. § 45-21.27(a)
Postponement

To a day certain no later than 90 days after the original date

N.C.G.S. § 45-21.21(a)
The statute’s own words
“postpone the sale to a day certain not later than 90 days after the original date for the sale”N.C.G.S. § 45-21.21(a)
